RELEASE OF LIABILITY AND WAIVER FOR SEWER LINE MAINTENANCE AND REPAIR CONSULTATION

By signing this release of liability and waiver (“Release”), the Releasor recognizes, accepts, and understands that the Ken-Caryl Ranch Water & Sanitation District (“District”) cannot guarantee that a sewer line does not require maintenance or repair. In consideration of the District providing a sewer line maintenance and repair consultation, the Releasor waives any and all claims against the District, whether based on contract, negligence or otherwise, which may arise out of any damages the Releasor may suffer to his/her sewer line or real or personal property. Releasor also releases the District, its officers, employees, agents and assigns regarding any claims, costs, and expenses which may arise out of any damage to his/her sewer line or real or personal property.

Nothing in this Release shall be construed to waive, limit, or otherwise modify any governmental immunity that may be available under the Colorado Governmental Immunity Act, C.R.S. 24-10- 101, et seq., to the District, its officials, employees, agents or other persons acting on behalf of the District.

Should any provision of this Release be held invalid, illegal, or unenforceable, it shall not affect or impair the validity, legality, or enforceability of any other provisions of this Release.
